Hotellerie e portali turistici, che fine ha fatto il diritto di replica?

Prenotare vacanze on-line è senza dubbio più stimolante e divertente che lasciare tutto in mano alle agenzie di viaggi ed attendere il giorno della partenza ma, quando navighiamo nel web alla ricerca del pacchetto più conveniente o dell’albergo più particolare, dobbiamo prestare attenzione soprattutto all’attendibilità della recensione.
Il fenomeno dei commenti fasulli è molto, anzi troppo diffuso in rete e spesse volte l’utente è tratto in inganno da una recensione poco lusinghiera o al contrario da elogi incondizionati per questo o quell’albergo.
Un punto sul quale dobbiamo ragionare è perché nei grandi siti di prenotazione turistica non è mai presente la replica dell’albergatore interessato?
Per quale motivo sui vari Booking.com e Expedia.it non esiste la possibilità per il gestore della struttura di poter dire la sua su un appunto negativo e, magari utilizzarlo per porre rimedio ai disagi di un prossimo cliente?
Secondo la carta dei diritti della comunicazione: “Ogni individuo ha il diritto di replica e di richiedere un indennizzo per danni causati da informazioni errate diffuse dai media. Le persone interessate dovrebbero avere l’opportunità di correggere, in modo tempestivo, affermazioni che li riguardano e che hanno un giustificato motivo per essere rettificate…. e così via”. E allora come mai un fantomatico hotel ha diritto, perché secondo la legge di questo si tratta di diritto, di replicare in forum turistici come Tripadvisor.it dove non esiste nemmeno la certezza che un determinato viaggiatore sia davvero stato in quella precisa struttura ma, non lo possiede in portali dove effettivamente il cliente prenota, fidandosi totalmente di ciò che legge?
Questo punto deve far riflettere, lo scopo di inserire un commento dovrebbe essere quello di agevolare un futuro viaggiatore, documentando la propria esperienza con numeri, date e fotografie. Chi si prende il disturbo di riportare la propria esperienza in rete e, nello stesso modo l’hotel di riferimento che si espone a critiche e giudizi, secondo voi non meritano almeno la possibilità di replicare?
A tal proposito nell’ottobre 2011 la Federalberghi (Federazione Italiana degli Albergatori) ha formulato una richiesta formale contro siti che accolgono commenti anonimi degli utenti. Con una lettera indirizzata al Ministero del Turismo e al Ministero delle Attività Produttive, il presidente Bernabò Bocca ha chiesto più tutela per le strutture ed in particolare: introduzione di norme per regolare le attività di blog e siti, il diritto di replica, l’obbligo della firma con nome e cognome sotto una data recensione e, se questa dovesse venir meno la presa di responsabilità da parte del sito. La protesta del presidente Bocca era indirizzata in modo particolare verso Tripadvisor.it acquistata in tempi non sospetti dal portale made in U.S.A. Expedia Inc. Proprio il cambio di proprietà e la continua presenza di anonimato hanno portato la Federalberghi ad agire per vie legali. Nello stesso modo si è mossa anche la Synhorcat (Associazione francese degli albergatori) che, secondo quanto riportato dal comunicato stampa visibile sul sito della Federalberghi datato 11/10/2011 ha trascinato in tribunale ancora una volta Expedia Inc. e Tripadvisor.it accusandoli di aver fornito al pubblico informazioni sbagliate circa la disponibilità di posti in determinate strutture a beneficio di altre, partner commerciali dello stesso sito e, di aver clamorosamente omesso di citare a molteplici clienti il legame tra Expedia e Tripadvisor. Presto fatto il Tribunale di Parigi ha condannato i due portali turistici insieme ad Hotels.com, facente parte dello stesso gruppo societario, a pagare un indennizzo di 430.000 mila euro alla Synhorcat per i danni causati.
Secondo voi tutto questo è giusto e, soprattutto è legale? Esiste un qualche uomo di legge, un avvocato esperto in materia che, come noi, vorrebbe cambiare la corrente delle cose come già è successo in Francia?
